The recent decision of the Supreme Court that authorizes the President to fire members of any federal agency other than the Fed is one of the most sweeping and baldly right-wing decisions ever taken in relation to the administrative state. It further advances the Unitary Executive Theory, the wet dream of the Scalia acolytes.
Essentially, either you’re for the administrative state or you’re against it. Either you think the modern world is so complex that we must have semi-independent federal appointees to do the things Congress or the President can’t do, such as determine how many rodent hairs are allowed in peanut butter — or you don’t.
Yesterday’s decision is a victory for those who don’t understand how complex the world has become; for those who think we can go back to some halcyon, simple world; for the scientifically ignorant.
It’s going to have very, very long coattails.
